TDS RETURN FILING
“FROM TAX DEDUCTION TO RECONCILED STATUTORY REPORTING.”
Comprehensive withholding tax compliance covering the Income-tax Act, 2025 framework, Section 392 (Salary) and Section 393 (Non-Salary) tables, Form 138, 140, 144, 141 filings, TRACES reconciliations, and Form 16/16A generation.
*Applicability, withholding rates, and statutory forms depend on the transaction date, payment category, and resident or non-resident payee status under the Income-tax framework.
Deduct tax at payment or credit (whichever is earlier), deposit by the 7th, file quarterly statements, and issue TRACES certificates.
PAYMENT DATE DETERMINES THE GOVERNING INCOME TAX ACT
Per official Income Tax Department guidance, the direct tax withholding regime operates on a clear transition timeline:
Income-tax Act, 1961
Governed by legacy sections (192, 194C, 194J, 194H, 194I, 194A) and quarterly statements in Forms 24Q, 26Q, and 27Q.
Income-tax Act, 2025
Governed by Section 392 (Salaries), Section 393 tables (Non-Salaries), and quarterly statements in Forms 138, 140, 144, and 141.
Notice on Rates & Contracts: Withholding rates and monetary thresholds have broadly been retained in corresponding tables under the 2025 Act. Existing commercial contracts do not automatically require amendment merely because the new Act commenced.
WHAT IS TAX DEDUCTED AT SOURCE?
TDS is a mechanism that requires the payer of an expense to deduct income tax at specified rates before making payments to vendors, contractors, landlords, professionals, or employees. The withheld amount is remitted to the government against the payee's PAN.
A structured TDS lifecycle follows five distinct stages:
- Applicability & Deduction
- Challan Deposit (By 7th)
- Quarterly Statement Filing
- TRACES Processing & Forms 16/16A
- Ledger-to-Challan Reconciliation
- Default & Demand Mitigation
DEDUCTOR VS DEDUCTEE
